Terms of Service
These Terms of Service ("Terms") constitute a binding agreement between you and Privio ("we," "us," or "our") governing your access to and use of the Privio application and associated services (collectively, the "Service"). By creating an account, you affirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must refrain from using the Service.
1. Eligibility
You must be of legal age to enter into a binding contract in your jurisdiction of residence to create an account. If you are using the Service to supervise or filter network activity on behalf of a minor within your household, you do so as the responsible account holder, and you remain accountable for compliance with these Terms.
2. Description of Service
Privio provides a subscription-based network filtering service that allows account holders to configure content restrictions, monitor filtering activity, and manage settings across registered devices. The specific features available to you depend on your selected subscription plan. We reserve the right to modify, enhance, or discontinue features of the Service at our discretion, provided that we will make reasonable efforts to notify you of material changes affecting your subscription.
3. Accounts and Registration
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate registration information and to promptly notify us of any unauthorized access to or use of your account. We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised or used in violation of these Terms.
4. Subscription Plans and Payment
Plans. The Service is offered under multiple subscription tiers, each with distinct features and device limits, as described within the application at the time of purchase.
Billing. Paid plans are purchased for a fixed period and paid through our third-party payment processor. Plans do not renew automatically: you are charged only when you choose to purchase or renew a plan.
Price Changes. We reserve the right to modify subscription pricing. Where a price change affects an active subscription, we will provide reasonable advance notice before the change takes effect.
Refunds. Except where required by applicable law, fees are non-refundable once a billing cycle has commenced. Where a statutory right to a refund or cooling-off period applies in your jurisdiction, that right shall govern to the extent it conflicts with this provision.
Cancellation. Because plans do not renew automatically, there is nothing to cancel: a paid plan simply ends when its paid period ends, and you keep its features until then. You may delete your account at any time through your account settings.
5. Acceptable Use
You agree not to:
- Use the Service for any purpose that is unlawful or prohibited by these Terms
- Attempt to circumvent, disable, or interfere with the security or proper functioning of the Service
- Reverse engineer, decompile, or attempt to extract the underlying architecture of the Service, except to the extent such restriction is prohibited by applicable law
- Use the Service to facilitate the filtering or monitoring of a device or network without appropriate authority to do so
- Resell, sublicense, or otherwise make the Service available to a third party outside the scope of your subscription entitlements
- Introduce malicious code or engage in conduct that could disrupt the integrity or availability of the Service for other users
Violation of this section may result in suspension or termination of your account, at our discretion, with or without notice depending on the severity of the violation.
6. Managed Devices and Supervision
You may connect devices to your account, including by scanning a pairing QR code on the other device. When you do, you confirm that you own the device or are legally entitled to manage it, and that the people who use it know that the account owner can see the website names the device looks up, apply internet schedules to it and block apps on it. Where the device is used by a child, you confirm that you are that child's parent or legal guardian.
You must not use the Service to secretly monitor another adult, or to monitor any person without the knowledge and authority described above. The Service is not designed to be hidden: a device shows a notice before it is connected, and a visible notification while protection is on. We may suspend or terminate accounts that are used for covert monitoring.
7. Intellectual Property
The Service, including its underlying software, design, and branding, is owned by us or our licensors and is protected by applicable intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. No other rights are granted by implication or otherwise.
8. Service Availability
We strive to maintain reliable access to the Service but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, technical difficulty, or circumstances beyond our reasonable control. We are not liable for any inconvenience or loss arising from such unavailability, except as required by applicable law.
9. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, we disclaim all warranties, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the filtering functionality of the Service will identify or restrict every instance of content you intend to restrict, and you acknowledge that the Service is one component of a broader approach to network safety rather than an absolute guarantee.
10. Limitation of Liability
To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or goodwill, arising out of or related to your use of the Service. Our aggregate liability arising out of or relating to these Terms or the Service shall not exceed the amount you paid to us for the Service during the twelve months preceding the event giving rise to the claim. Nothing in this section limits any liability that cannot be excluded or limited under applicable law.
11. Indemnification
You agree to indemnify and hold us harmless from any claim, liability, or expense, including reasonable legal fees, arising from your violation of these Terms or your misuse of the Service.
12. Termination
We may suspend or terminate your access to the Service at our discretion, including where we reasonably believe you have violated these Terms, engaged in fraudulent activity, or posed a risk to the security or integrity of the Service. You may terminate your account at any time through your account settings. Provisions of these Terms which by their nature should survive termination, including but not limited to intellectual property, disclaimers, and limitation of liability, shall so survive.
13. Changes to These Terms
We may revise these Terms periodically. Where changes are material, we will provide reasonable notice through the Service prior to the changes taking effect. Your continued use of the Service following such notice constitutes your acceptance of the revised Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws applicable in the jurisdiction in which we are established and operate, without regard to conflict of laws principles. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts having competent authority over that jurisdiction, unless otherwise required by a mandatory provision of the law applicable in your own jurisdiction of residence.
